14th ATP to CLP

The European Commission (EC) is has opened a consultation on the 14th adaptation to technical progress (ATP) of the CLP Regulation.

The purpose of this draft Regulation is to amend table 3 to Annex VI of the CLP Regulation by introducing new or revised entries for the harmonised classification and labelling of 28 substances and by removing 2 substances.

It also amends Annexes II and III to the CLP Regulation by defining specific labelling obligation for mixtures containing titanium dioxide.

Lastly, the classification of the substance pitch, coal tar, high temp. is corrected.

The final date for comments is 60 days after notification.

The proposed date of adoption is first quarter of 2019., with the proposed date of entry into force being 20 days after publication in the EU Official Journal.

ADR 2019 CORRIGENDA

ADR 2019 has only just been published and there are already 2 corrigenda to the printed version. These are available from the United Nations Economic Commission for Europe (UNECE) web site at the following address: www.unece.org/trans/danger/danger.html or contact us for copies.

REACH ANNEXES TO BE AMENDED

The European Commission (EC) has just began a 4 week consultation on amending Annexes I and V of the REACH Regulation.

2 types of amendments are needed to REACH:

  • Some terms in Annexes I and V need amending to bring REACH into line with the CLP Regulation, as REACH’s existing terminology comes from 2 directives that were repealed by that Regulation.
  • Digestate must be listed in Annex V, which already lists compost and biogas and thereby exempts them from registration obligations.

Digestate is a residual semisolid or liquid material of anaerobic digestion processes of biodegradable materials originating from non-hazardous sources, such as food waste, manure and energy crops.

So far, no registrations have been submitted for digestate. The listing of digestate in Annex V of REACH should clarify that digestate is exempted from registration, for reasons analogous to those that justify the existing exemption of compost and biogas, thereby removing uncertainties encountered by producers and users of digestate and by enforcement authorities.

The consultation runs from 10 December until 7 January 2019.
